Terms of Service
1. Acceptance of Terms
By accessing or using the Whisper Valley website at whisperv.com, or by applying for, enrolling in, or participating in any Whisper Valley membership program, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.
These Terms constitute a legally binding agreement between you ("Member" or "User") and WHISPER VALLEY, the owner and operator of Whisper Valley.
2. About Whisper Valley
Whisper Valley is a private golf club offering tiered membership programs, curated events, and exclusive member benefits. Membership is granted at the sole discretion of the Whisper Valley membership committee and is subject to availability, eligibility review, and the payment of applicable fees.
Whisper Valley is a premium brand owned, maintained, and operated by WHISPER VALLEY.
3. Membership Eligibility
Membership in Whisper Valley is limited. Acceptance of an application does not guarantee admission. The membership committee reserves the right to approve or decline any application without providing a reason. All applicants must:
- Be 21 years of age or older
- Complete the application form with accurate and truthful information
- Submit the required non-refundable application fee for their chosen tier
- Agree to abide by the Whisper Valley Club Rules and Code of Conduct
4. Fees and Payments
All fees are stated in United States Dollars (USD). By submitting any payment, you authorize WHISPER VALLEY to process your payment immediately via the designated payment processor. Current fee schedules are as follows:
- The Reserve Waitlist: $50 per month, billed automatically on a recurring monthly basis. This subscription grants priority waitlist status pending a core membership vacancy.
- Social & Leisure Membership: $1,000 non-refundable application fee. Annual dues and minimum spend requirements apply upon admission.
- Valley Executive Membership: $2,500 non-refundable application fee. Annual dues and minimum spend requirements apply upon admission.
- Founder Member: $5,000 non-refundable application fee. Founder Members receive lifetime dues waiver and full access to all club privileges upon committee approval.
All application fees cover services rendered immediately upon submission, including background verification, concierge onboarding, and administrative processing, and are therefore non-refundable under all circumstances. Subscription-based programs are billed automatically each month on a recurring basis until cancelled. You will be notified of any changes to pricing at least 30 days in advance.
5. Cancellation and Refunds
Cancellation and refund terms are governed by our Refund & Cancellation Policy, which is incorporated into these Terms by reference. Please read that policy carefully before submitting any payment.
6. Member Conduct
Members agree to conduct themselves with courtesy and respect at all times on club premises and in all interactions with club staff, fellow members, and guests. WHISPER VALLEY reserves the right to suspend or terminate a membership, without refund, for conduct that is disruptive, disrespectful, unlawful, or otherwise contrary to the values of the Whisper Valley community.
7. Privacy
Your use of Whisper Valley services is subject to our Privacy Policy, which describes how we collect, use, and protect your personal information.
8. Intellectual Property
All content on whisperv.com — including but not limited to text, photography, graphics, logos, and design — is the exclusive property of WHISPER VALLEY. Unauthorized reproduction, distribution, or use of any content is strictly prohibited.
9. Limitation of Liability
To the fullest extent permitted by applicable law, WHISPER VALLEY shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services or any membership program. Our total liability to you shall not exceed the amount paid by you to WHISPER VALLEY in the 12 months preceding the claim.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts of Massachusetts.
11. Indemnification
You agree to indemnify, defend, and hold harmless WHISPER VALLEY, its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of our services, your violation of these Terms, or your violation of any rights of another person or entity.
12. Dispute Resolution
In the event of a dispute arising under or relating to these Terms, the parties agree to first attempt to resolve the dispute through good-faith negotiation. If the dispute cannot be resolved by negotiation within 30 days, either party may submit the matter to binding arbitration in accordance with the rules of the American Arbitration Association, with proceedings conducted in Massachusetts. Notwithstanding the foregoing, WHISPER VALLEY reserves the right to seek injunctive or other equitable relief in any court of competent jurisdiction.
13. Entire Agreement; Severability
These Terms, together with our Privacy Policy and Refund & Cancellation Policy, constitute the entire agreement between you and WHISPER VALLEY with respect to your use of our services and supersede all prior and contemporaneous agreements, representations, and understandings. If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, and all other provisions shall remain in full force and effect.
14. Waiver
No waiver of any term or condition of these Terms shall be deemed a further or continuing waiver of such term or condition. WHISPER VALLEY's failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
15. Changes to These Terms
WHISPER VALLEY reserves the right to update these Terms at any time. Material changes will be communicated to active members via email. Continued use of our services following notice of changes constitutes acceptance of the updated Terms.
